Introduction
Welcome to the The Citizens Application for Political Participation (CAPP) (the “Service”). CAPP is a CivicTech tool endorsed by the School of Politics, Policy and Governance (SPPG). It is designed to facilitate two-way communication between the government and its citizens, empowering Nigerian citizens to actively participate in the democratic process. By using CAPP, you agree to be bound by the following terms and conditions. These Terms of Use ("Terms") govern your use of our website, mobile application, and any related services provided by CAPP ("we," "us," or "our"). By accessing or using the service, you agree to comply with and be bound by these Terms. If you do not agree to these terms, please do not use the service.
Definitions
"We," "us," "our," refers to CAPP and its affiliates.
"You," "your," "user," refers to the individual using CAPP.
"Service," refers to the services provided by CAPP.
Eligibility
You must be at least 18 years old to use the Service. By using the Service, you represent and warrant that you meet this age requirement.
Account Registration
Registration: To access certain features of the Service, you may be required to create an account. You agree to provide accurate and complete information during the registration process.
Account Security: You are responsible for maintaining the confidentiality of your account information and password. You agree to notify us immediately of any unauthorized use of your account.
Services
CAPP provides the following services to enhance civic engagement and political participation:
Civic Education: Access to educational modules and materials on governance and civic engagement.
Policy Library: A repository of policy documents, laws, and regulations.
Know Your Leaders: A platform for communication and feedback between citizens and elected officials.
Join a Political Party: Facilitation of joining and participating in political parties.
Know Your MDAs: Information about government agencies and their functions.
FGN Support Schemes: Access to federal government support schemes.
User Obligation
Accuracy of Information: You agree to provide accurate and complete information when using CAPP.
Compliance: You agree to use CAPP in compliance with all applicable laws and regulations.
Security: You are responsible for maintaining the confidentiality of your account information and for all activities that occur under your account.
Payment and Fees
Signup Fees: Any applicable fees for accessing certain features of CAPP will be clearly communicated during the signup process. At this time, using CAPP is free of charge.
Payment Methods: Payments for donations can be made via Direct Bank Transfer, payment at partnered banks, or through the CAPP website or App payment gateway.
Notification: Users will receive payment confirmation via email or SMS.
Cancellation and Refund
Cancellation Policy: Users may cancel their use of CAPP services or CAPP reserves the right to cancel users who abuse the terms of use or refuse to use the app and its services responsibly.
LIMITATION OF LIABILITY
No Liability: CAPP shall not be liable for any direct, incidental, consequential, indirect, special, punitive, or similar damages arising from the use of the service.
Third-Party Services: CAPP is not responsible for any issues related to payments processed by third-party payment gateways.
Political Party Affiliation: CAPP does not affiliate with any political party as this is the office of the citizens, discharging its duties to be inclusive regardless of political party differences. All political parties have equal rights and treatment within the CAPP ecosystem.
Communication
Means of Communication: CAPP may communicate with users via notices, emails, messages, alerts, and statements.
Contact Information: Users should ensure their contact information is up-to-date to receive communications from CAPP.
CHANGES TO TERMS AND CONDITIONS
CAPP reserves the right to modify these terms and conditions at any time. Users will be notified of any changes via email or through the CAPP website.
Indeminity
IN CONSIDERATION of the Citizens Application for Political Participation (hereinafter called “CAPP”) providing its services, including but not limited to facilitating citizen engagement, political participation, and the dissemination of information its platform within the legal framework of the FOI Act for citizens use, I “user” “profiled leader” “MDA” hereby fully indemnify CAPP, its founders, directors, agents, affiliates, employees, assigns, successors, or any other person acting under CAPP’s authority or control against any costs, losses, damages, litigation, action, proceeding, expenses (including attorney’s fees), judicial awards of any kind, or any payments of whatsoever nature made or any costs incurred, whether directly or indirectly, resulting from my use of CAPP’s services.
Furthermore, I “user” “profiled leader” “MDA” hereby irrevocably and unconditionally agree that my obligations herein shall not be reduced by any claim against CAPP, its founders, directors, agents, affiliates, employees, assigns, successors, or any other person acting under CAPP’s authority.
This indemnity shall be a continuing obligation in respect of any and all matters connected to or arising from my use of CAPP’s services. This Indemnity shall remain valid and in full force from the date of its execution until CAPP issues a letter discharging me from my obligations herein.
GOVERNING LAW
These Terms and Conditions are governed by the laws of the Federal Republic of Nigeria and shall be subject to the jurisdiction of the courts of the Federal Republic of Nigeria.
ENTIRE AGREEMENT
These Terms and Conditions constitute the entire agreement between CAPP and the user. Any prior agreements, representations, or understandings are superseded by these terms.
